These Terms of Service (“Terms”) govern your access to and use of the CABIN mobile application and related services (collectively, the “Service”) operated by CABIN (“CABIN,” “we,” “us,” or “our”).
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use CABIN.
1. About CABIN
CABIN is a private recommendation and collection app designed to help users intentionally save, revisit, and share films, books, podcasts, and ideas worth keeping. CABIN is not a public social network, feed, or marketplace.
2. Eligibility
You must be at least 13 years old to use CABIN.
By using the Service, you represent that:
- You meet the age requirement
- You have the legal capacity to enter into these Terms
- Your use of CABIN complies with applicable laws
3. Account Registration and Security
You are responsible for:
- Providing accurate account information
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
You agree to notify us immediately of any unauthorized access or security breach.
4. Your Content
a. Ownership
You retain ownership of any content you submit, save, or share through CABIN (“User Content”), including recommendations, notes, and lists.
b. License to CABIN
By using the Service, you grant CABIN a limited, non-exclusive, royalty-free license to store, display, and process your User Content solely for the purpose of operating and improving the Service.
CABIN does not claim ownership of your recommendations.
5. Sharing and Social Features
- You control what you share and with whom.
- Recommendations are shared only with friends you explicitly approve.
- CABIN is not responsible for how recipients interpret or use shared recommendations.
There are no public profiles, follower counts, or algorithmic feeds.
6. Acceptable Use
You agree not to:
- Use CABIN for unlawful, harmful, or abusive purposes
- Upload content that infringes intellectual property or privacy rights
- Attempt to access or interfere with CABIN’s systems or security
- Use automated tools to scrape or misuse the Service
We reserve the right to suspend or terminate accounts that violate these Terms.
7. Intellectual Property
All CABIN software, design, trademarks, and branding are owned by CABIN or its licensors and are protected by intellectual property laws.
You may not copy, modify, distribute, or reverse engineer any part of the Service without prior written permission.
8. Third-Party Services
CABIN may integrate with or link to third-party services (e.g., metadata providers for books or films).
We are not responsible for:
- Third-party content or accuracy
- Third-party privacy practices or terms
- Any damages arising from third-party services
Your use of third-party services is governed by their respective terms.
9. Termination
You may stop using CABIN at any time and request account deletion.
We may suspend or terminate your access if:
- You violate these Terms
- Your use poses legal, security, or operational risks
- We are required to do so by law
Upon termination, your right to use the Service ends immediately.
10. Disclaimers
CABIN is provided “as is” and “as available.”
We do not guarantee that:
- The Service will be uninterrupted or error-free
- Recommendations will be accurate or suitable for your needs
- Content will be preserved indefinitely
Use CABIN at your own discretion.
11. Limitation of Liability
To the maximum extent permitted by law:
- CABIN shall not be liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid to use CABIN in the 12 months preceding the claim (or zero if the Service is free)
Some jurisdictions do not allow certain limitations; in such cases, limits apply to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless CABIN from any claims, damages, or expenses arising from:
- Your use of the Service
- Your User Content
- Your violation of these Terms or applicable laws
13. Changes to the Service or Terms
We may modify the Service or these Terms from time to time.
If changes are material, we will provide reasonable notice through the app or other means. Continued use of CABIN after changes constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict of law principles.
Any disputes shall be resolved exclusively in the courts located in British Columbia, Canada.
